Terms of Service

Plain English: Use the site for personal hockey research. Don't scrape or resell it. Subscriptions renew automatically until you cancel. Monthly plans are non-refundable; annual plans get a partial refund on cancellation (full details in the Subscription Agreement). We reserve the right to suspend abusive accounts.

1. Agreement

These Terms of Service ("Terms") are a contract between you and S.P.A. Sports Performance Analysis ("we," "our," "us"), based in British Columbia, Canada, covering your use of DraftResearch.com and any related tools, APIs, or subdomains (collectively, the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Eligibility

You must be at least 13 years old (16 in the EU/EEA) to use the Service. By using it, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you're using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. The Service

DraftResearch.com provides hockey research tools, including draft re-projection, prospect probabilities, career production tables, trade analysis, and editorial intelligence. Free features are available to anyone; certain features require a paid DraftResearch Pro subscription. We may add, modify, or discontinue features at any time.

4. Accounts

You're responsible for keeping your account credentials secure. Don't share your login. Notify us immediately at [email protected] if you suspect unauthorized access. You are responsible for all activity that occurs under your account.

5. Subscriptions & billing

DraftResearch Pro is offered on monthly and annual billing cycles. All payments are processed by Stripe, Inc.; we do not see or store card numbers. By subscribing you also agree to Stripe's Services Agreement for end users.

  • Automatic renewal. Subscriptions renew automatically at the end of each billing period until cancelled. Cancel anytime from your account page or by emailing [email protected]. We send a renewal reminder before each annual renewal and before any material price change.
  • Cancellation effect. When you cancel, your subscription remains active for the rest of the period you've already paid for, and renewal stops at the end of that period. You keep full access until the end of the paid period.
  • Saved payment methods. Stripe stores your payment method on file so renewals can process automatically. You can remove or change a payment method at any time via your account page.
  • Price changes. We may change pricing; we'll notify you by email at least 30 days before any change takes effect. If you don't agree, cancel before renewal.
  • Taxes. Prices may exclude applicable sales taxes (GST/PST/HST in Canada, VAT in the EU/UK, etc.); Stripe collects taxes where required.
  • Failed payments. If a payment fails, we'll retry per Stripe's standard retry schedule. If recovery fails, the subscription is paused and Pro features are gated until payment is restored.
  • Disputes. If you believe a charge is incorrect, contact [email protected] within 60 days of the charge. We'll investigate and respond within 10 business days.

6. Refund policy

Monthly subscriptions are non-refundable. When you cancel a monthly subscription, your access continues through the end of the month you have already paid for, and the subscription will not renew.

Annual subscriptions are partially refundable. If you cancel an annual subscription before the end of its 12-month term, we refund the unused portion: each month you have already had access is repriced at the standard $9.99 CAD/month rate (the annual discount no longer applies), and the difference is refunded to your original payment method within 10 business days.

The full refund calculation, examples, and edge cases are set out in the DraftResearch Pro Subscription Agreement. In the event of any conflict between this section and the Subscription Agreement, the Subscription Agreement controls.

Chargebacks made without first contacting [email protected] may result in immediate account suspension.

This policy does not affect any non-waivable statutory rights you may have under applicable consumer-protection law (for example, the BC Business Practices and Consumer Protection Act, or EU consumer law).

7. Acceptable use

Don't:

  • Scrape, mirror, crawl, or systematically download the Service or its data.
  • Resell, sublicense, or redistribute the Service or its outputs.
  • Reverse-engineer, decompile, disassemble, or attempt to extract source code.
  • Bypass authentication, rate limits, paywalls, or any technical access controls.
  • Use the Service to harass, defame, threaten, or harm any person or organization.
  • Submit malicious content (malware, phishing, spam, or any content that violates law).
  • Use the Service to train machine-learning models without a separate written agreement.
  • Misrepresent your identity or affiliation, or impersonate any person.
  • Probe, scan, or test the vulnerability of the Service without our prior written consent.

We may suspend or terminate accounts that violate these rules without notice. Repeated or severe violations may be reported to law enforcement.

8. Intellectual property

The Service, including all proprietary models, datasets, analyses, visualizations, articles, and code, is owned by S.P.A. Sports Performance Analysis and protected by copyright, trademark, and other laws. Subscribers receive a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal hockey research.

Source data (player names, draft results, league statistics, and biographical information) is aggregated from a combination of publicly available sources, including national and international hockey federation websites, the National Hockey League, and other public statistics sites. Our value-add is in the modelling, structure, and analysis. You may reference small excerpts in personal writing with attribution to DraftResearch.com; commercial reuse, republication, or systematic export requires written permission.

All trademarks, logos, and service marks displayed on the Service are the property of their respective owners.

9. User submissions

If you submit feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a worldwide, perpetual, royalty-free licence to use that Feedback for any purpose without compensation or attribution to you. We don't currently host public user-generated content; if we add such a feature, additional terms will apply.

10. Third-party services

The Service relies on third-party processors including Stripe (payments), Google Analytics (analytics), PostHog (analytics), and Cloudflare (hosting). Your use of those services is also governed by their respective terms and privacy policies. We are not responsible for third-party services or content linked from the Service.

11. Data accuracy & service availability

We work hard to keep the data accurate, but the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Projections, ratings, and grades are statistical estimates — not guarantees of player outcomes. Don't use the Service as the sole basis for any binding decision (drafting, contract negotiations, wagering, etc.).

Hockey statistics change daily; figures may lag the most recent game state. We do not warrant that the Service will be uninterrupted, error-free, or secure, and we do not offer a formal uptime SLA. We perform routine maintenance and may schedule downtime for upgrades; where reasonably possible we'll announce significant downtime in advance.

12. Limitation of liability

To the maximum extent permitted by law, S.P.A. Sports Performance Analysis, its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the Service. Our aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) CAD $100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

13. Indemnity

You agree to defend, indemnify, and hold harmless S.P.A. Sports Performance Analysis and its representatives from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

14. Termination

You may close your account at any time by contacting [email protected]. We may suspend or terminate access if you breach these Terms, for legal or security reasons, or if we discontinue the Service. Sections that by their nature should survive (Intellectual Property, Disclaimer, Limitation of Liability, Indemnity, Governing Law) remain in effect after termination.

15. Changes to these terms

We may update these Terms from time to time. Material changes will be announced via email to account holders or a banner on the site at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance. If you don't agree to a change, cancel before the effective date.

16. Governing law & dispute resolution

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts located in Vancouver, British Columbia, and you consent to the jurisdiction of those courts — except where applicable consumer-protection law gives you the right to bring claims locally.

17. General

  • Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us about the Service and supersede any prior agreements.
  • Severability. If any provision is held unenforceable, the remainder remains in effect.
  • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Headings. Section headings are for convenience only and do not affect interpretation.
